1. Applicability and Nature of Terms

The internet resource, www.amaara.com (“Website”), as well as the software and applications provided by Amaara (“Apps”), (together, with the Website and the Apps, referred to as the “Services”), are owned and operated by Amaara Vectors Private Limited, a company duly incorporated under the provisions of the Companies Act, 2013 (“Amaara”, “We”, “Our” or “Us”). Through the provision of its Services, Amaara facilitates storage, transmission and access of medical information for organizations and individuals.

These Terms of Use apply to You whether You are:

  • A medical administrator, practitioner, or health service provider;
  • A patient, to whose information or data we are provided access during Services;
  • Any other user of the Services.

Your access or use of the Services is governed by these Terms of Use, the Privacy Policy, End User License Agreement and Payment Terms (if applicable). By accessing, browsing, or using the Website or Apps, You signify agreement to these Terms.

Amaara reserves the right to change or modify these Terms at any time. Any changes are effective immediately upon posting. Continued use confirms acceptance.

2. Eligibility

To avail the Services, You are required to register. Amaara may collect personal information including Name, Email, Address, Gender, Age, Mobile number, financial details, and other volunteered details.

By registering, You represent and warrant that You are competent to contract under Indian law, and have the authority to use the Services.

3. Use of Services and the Website

Amaara facilitates storage, transmission and access of digital medical information. Patients are owners of their data, Amaara only transmits and provides access. Authenticity and accuracy of data is the responsibility of providers and patients.

Amaara is not responsible for healthcare advice, diagnosis, breach of contracts between Users, or any medical/legal/financial outcomes of Services.

The Services must not be used for illegal purposes. Unauthorized access, attempts to hack, or solicit user logins are violations of these Terms and applicable laws.

Refund Policy: Currently no refunds are offered as charges apply post-utility of Services.

4. Other Terms

Amaara reserves the right to maintain, delete, or destroy communications and materials posted/uploaded during use of Services. Users are responsible for maintaining confidentiality of accounts and must not share passwords.

4.5 Liability

Services are provided “as is” without warranties. To the maximum extent permitted by law, Amaara and affiliates are not liable for direct, indirect, incidental, punitive or consequential damages. Users agree to indemnify Amaara and its representatives against any claims arising from misuse or violation of these Terms.

5. Termination

These Terms remain until terminated by You or Amaara. You may terminate by ceasing to use Services and notifying Amaara. Amaara may terminate for breach of law, Terms, inability to authenticate information, or at its sole discretion.

Upon termination, Amaara may delete all user data unless legally prohibited. Amaara reserves the right to suspend or permanently ban access.

6. Applicable Law and Dispute Settlement

These Terms are governed by Indian law. Courts at Bangalore, Karnataka shall have exclusive jurisdiction. Disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996. Venue: Bangalore. Language: English.

7. Grievance Redressal

The designated grievance officer is Mr. Arjun Ravindra, reachable via the same email, who shall redress grievances within one month of receipt.

8. Severability

If any provision of these Terms is unenforceable, the remainder shall continue in effect, with interpretation adjusted to preserve intent.

9. Waiver

No provision shall be deemed waived unless signed in writing by Amaara. A waiver of one breach does not constitute a waiver of other breaches.
