Amaara Vectors Private Limited (“Us”, “We ”, “Our” or “Amaara”) is the author and publisher of the internet resource, www.amaara.com (“Website”) on the world wide web as well as certain software applications provided by Amaara (collectively referred to as “ Apps”), (together, with the Website and the Apps, referred to as the “Services”).

This privacy policy (“Privacy Policy”) applies to You whether You are:

(a) A Medical Administrator, Medical Practitioner, or other Medical/ Health Care service provider (whether an individual professional or an organization) or similar institution availing the Services, including designated, authorized associates and employees of such practitioners or institutions;

(b) A Patient, to whose information or data, We are provided access in the course of providing the Services, or his/her representatives or affiliates; or

(c) Any other user of the Services

Entities/ persons referred to in (a), (b) and (c) above, shall hereinafter, be referred to as “End-User”, “You” or “User”.

BY USING THE SERVICES OR BY OTHERWISE GIVING US YOUR INFORMATION, YOU WILL BE DEEMED TO HAVE READ, UNDERSTOOD AND AGREED TO THE TERMS, PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY AND AGREE TO BE BOUND BY THE SAME. YOU HEREBY CONSENT TO OUR COLLECTION, USE, SHARING AND DISCLOSURE OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. WE RESERVE THE RIGHT TO, AT ANY TIME, CHANGE, MODIFY, ADD OR DELETE PORTIONS OF THIS PRIVACY POLICY, AT OUR SOLE DISCRETION. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, DO NOT USE ANY OF THE SERVICES OR GIVE US ANY OF YOUR INFORMATION.

1. CONTEXT & PURPOSE

1.1. This Privacy Policy applies to Your use of the Services. We created this Privacy Policy to demonstrate our commitment to the protection of your privacy and your personal information. For the purpose of providing the Services and for other purposes identified in this Privacy Policy, We will be required to collect and host certain data and information of the Users. We are committed to protecting the Personal Information of the Users and to take all reasonable precautions for maintaining confidentiality of the User’s Personal Information. This Privacy Policy has been designed and developed to help You understand the following:

(a) The type of Personal Information (including Sensitive Personal Data or Information) that We collect from Users;

(b) The purpose of collection, means and modes of usage of such Personal Information by Us;

(c) How and to whom We will disclose such information;

(d) How We will protect the Personal Information including Sensitive Personal Data or Information that is collected from Users; and

(e) How Users may access and/ or modify their Personal Information.

1.2. This Privacy Policy is published in compliance with, inter alia, the following:

(a) Section 43A of the Information Technology Act, 2000;

(b) Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011; and

(c) Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

2. WHAT IS THE PERSONAL INFORMATION?

(a) “Personal Information” means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available with Amaara, is capable of identifying the person concerned (and includes but is not limited to Sensitive Personal Data or Information).

(b) “Sensitive Personal Data or Information” means Personal Information of any individual relating to password; financial information such as bank account or credit card or debit card or other payment instrument details; physical, physiological and mental health condition; sexual orientation; medical records and history; biometric information; any detail relating to the above as provided to or received by Amaara for processing or storage. However, any data/ information relating to an individual that is freely available or accessible in the public domain or furnished under the Right to Information Act, 2005 or any other law shall not qualify as Sensitive Personal Data or Information.

3. TYPES OF PERSONAL INFORMATION COLLECTED BY AMAARA:

The type of information that Amaara may collect/ receive in order to provide You the Services, shall include:

  • Your Name
  • Your Mobile Number
  • Your Age
  • Your Gender
  • Your email address
  • Your medical information as provided from time to time
  • Your work or organization data (not applicable to Users who are patients)

Internet use: Amaara may also receive and/or hold information about the User’s browsing history including the URL of the site that the User visited prior to visiting the Website and the Apps as well as the Internet Protocol (IP) address of each User's computer (or the proxy server a User used to access the World Wide Web), User's computer operating system and type of web browser the User is using as well as the name of User's ISP. The Website uses temporary cookies to store certain data (that is not Sensitive Personal Data or Information) that is used by Amaara and its service providers for the technical administration of the Website, research and development, and for User administration.

4. PURPOSES FOR WHICH YOUR INFORMATION MAY BE USED BY AMAARA:

Amaara will retain User’s Personal Information only to the extent it is necessary to provide Services to the Users. The information which Amaara collects from You may be utilized for various business and/or regulatory purposes, including for the following purposes:

(a) Registration of the User on the Website and the App;

(b) Processing the User’s orders / requests and provision of Services (including provision of safe Services);

(c) Completing transactions with Users effectively and billing for the products/ Services provided;

(d) Technical administration and customization of Website and the Apps;

(e) Ensuring that the Website and the Apps content is presented to the Users in an effective manner;

(f) For the purpose of maintaining records on behalf of medical service providers with whom we are affiliated and whose services the Patient has availed;

(g) Improvement of Services, features and functionality of the Website and the Apps;

(h) Debugging customer support related issues;

(i) Research and development and for User administration (including conducting user surveys);

(j) For the purpose of contacting You to complete any transaction if you do not complete a transaction after having provided us with your contact information in the course of completing such steps that are designed for completion of the transaction;

(k) Non-personally identifiable information, exclusively owned by Amaara may be used in an aggregated or non-personally identifiable form for medical research, statistical analysis and business intelligence purposes including those for the purposes of determining the number of visitors and transactional details, and Amaara may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates;

(l) Dealing with requests, enquiries, complaints or disputes and other customer care related activities including those arising out of the Users’ request of the Services and all other general administrative and business purposes;

(m) Communicate any changes in our Services or this Privacy Policy, the Terms of Use or the End User License Agreement applicable to the Users;

(n) Verification of identity of Users and perform checks to prevent frauds;

(o) Investigating, enforcing, resolving disputes and applying our Terms of Use, Privacy Policy and End User License Agreement, either ourselves or through third party service providers;

(p) Analyzing software usage patterns for improving product design and utility;

(q) Analyzing anonymized practice information for commercial use;

(r) Contacting Users for offering new products or services; and

(s) Contacting End-Users for taking product and Service feedback;

5. DISCLOSURE AND TRANSFER OF YOUR PERSONAL INFORMATION:

5.1. Amaara may need to disclose/ transfer User’s Personal Information to the following third parties for the purposes mentioned in this Privacy Policy, and the Terms of Use applicable to such User:

(a) To government institutions/ authorities to the extent required (i) under the laws, rules, and regulations and/ or under orders of any relevant judicial or quasi-judicial authority; (ii) to protect and defend the rights or property of Amaara; (iii) to fight fraud and credit risk; (iv) to enforce Amaara’s Terms of Use applicable to the Users; or (v) when Amaara, in its sole discretion, deems it necessary in order to protect its rights or the rights of others.

(b) If otherwise required by an order under any law for the time being in force including in response to enquiries by government agencies for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences.

5.2. Amaara makes User’s Personal Information accessible to its employees and data processors only on a need-to-know basis. All Amaara employees and data processors, who have access to, and are associated with the processing of the User’s Personal Information, are obliged to respect its confidentiality.

5.3. Amaara may share its aggregate findings or data analysed basis the User’s Personal Information to prospective, investors, strategic partners, sponsors and others in order to help growth of Amaara’s business.

5.4. Amaara may also disclose or transfer the User’s Personal Information, to another third party as part of reorganization or a sale of the assets or business of Amaara. Any third party to which Amaara transfers or sells its assets will have the right to continue to use the User’s Personal Information and/ or other information that a User provides to Us.

5.5. Collection, use and disclosure of information which has been designated as Personal Information or Sensitive Personal Data or Information under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 requires Your express consent. By affirming Your assent to this Privacy Policy, You provide Your consent to such use, collection and disclosure as permitted under applicable law. Further, paragraph 1.6 of the Terms of Use is hereby specifically incorporated into this Privacy Policy mutatis mutandis, by way of reference, and by affirming Your assent to this Privacy Policy, You shall be deemed to have specifically provided Your affirmation to the provisions of the said paragraph 1.6 of the Terms of Use, as read into this Privacy Policy.

6. RETENTION OF THE INFORMATION:

6.1. All the information collected/ stored under this Privacy Policy, and Terms of Use applicable to the Users, is maintained by Us in electronic form on its equipment, and/ or on the equipment of Our employees. User’s Personal Information may also be converted to physical form from time to time. Regardless of the manner of storage, We will keep all User’s Personal Information confidential and will use/ disclose it only the manner specified under the Privacy Policy, and Terms of Use applicable to the Users.

6.2. We will retain Your information for as long as you are provided with the Services. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise permitted under any other law for the time being in force. Please note that Your withdrawal of consent may result in, Us being unable to provide You with its Services, or Us having to terminate any existing relationship that may have with You.

6.3. Copies of your data may be anonymized, and then may be held by us (whether or not We are, at such time, providing the Services to You) for as long as permitted under applicable law.

7. SECURITY PRACTICES AND PROCEDURES:

We have implemented best international market practices and security policies, rules and technical measures to protect the personal data that We have under Our control, from unauthorised access, improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss. However, for any data loss or theft due to unauthorized access to the User’s electronic devices through which the User avails the Services, We shall not be held liable for any loss whatsoever incurred by the User. We adopt reasonable security practices and procedures to include, technical, operational, managerial and physical security control measures that are commensurate with respect to the information being collected and the nature of Our business, in order to protect the Personal Information in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction.

8. USERS' RIGHTS IN RELATION TO THEIR PERSONAL INFORMATION COLLECTED BY AMAARA:

8.1. All the information provided to Us by a User, including Sensitive Personal Data or Information, is voluntary. User has the right to withdraw his/ her/ its consent at any time, in accordance with the terms of this Privacy Policy, and the Terms of Use applicable to such User, it being however clarified that withdrawal of consent will not be retroactive.

8.2. If a User has inadvertently submitted any Personal Information to Us prior to reading the Privacy Policy, the Terms of Use and the End User License Agreement applicable to such User, and such User does not agree with the manner in which such information is collected, stored or used, then such User can ask Us, by sending an email to help@amaara.com, containing the rectification required, and every User is also entitled to require Us to delete and destroy all such information (except anonymized information) relating to such User (but not other Users) in Our possession.

8.3. In case the User does not provide his/ her information or consent for usage of Personal Information or subsequently withdraws his/ her consent for usage of the Personal Information so collected, We reserve the right to discontinue the Services for which the said information was sought.

8.4. ADDITIONAL NOTES TO THE USER:

8.4.1. We shall not be responsible in any manner for the authenticity of the Personal Information or Sensitive Personal Data or Information supplied by or received from the User. If a User provides any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, We have the right to suspend or cease to provide our Services.

8.4.2. We shall not be responsible for any breach of security or for any actions of any third parties that receive Users' Personal Information or events that are beyond the reasonable control of Amaara including, acts of government, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.

8.4.3. You are responsible for maintaining the accuracy of information such as Your contact information provided as part of account registration. If Your personal information changes, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through help@amaara.com. We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable. If You provide any such information that is untrue, inaccurate, out of date or incomplete (or becomes untrue, inaccurate, out of date or incomplete), or We have reasonable grounds to suspect that the information provided by You is untrue, inaccurate, out of date or incomplete, We may, at our sole discretion, discontinue the provision of the Services to You.

8.5. GRIEVANCE REDRESSAL

We address discrepancies and grievances of all Users with respect to processing of information in a time bound manner. For this purpose, We have designated Arjun Ravindra as the grievance officer, who will redress the grievances of the Users expeditiously but within one month from the date of receipt of grievance, and who can be reached by:
